The Hope for Fertility Foundation provides grants to eligible couples who fully complete and submit a grant application and are selected by the grant committee.
Accepting the Terms
By signing up for an account, submitting a grant application, or by submitting a donation to The Hope for Fertility Foundation, you are accepting these Terms of Service.
Appication Fees
An application fee may be required in order to submit a grant application. Grant applications fees help support The Hope for Fertility Foundation’s operations and future grants. Grant applications fees are non-refundable.
The grant application fee is currently $50, but may be adjusted from time-to-time as needed. Should a change to application fees need to occur, changes will only happen outside of any current grant cycles. Grant cycles generally occur between January 1st and July 1st.
No Guarantee of Grant
The Hope for Fertility Foundation generally receives more applications during each grant cycle than the number of grants are available. The number of available grants per grant cycle varies from cycle-to-cycle. The submission of a grant application does not guarantee the applicant will receive a grant.
Donations
The Hope for Fertility Foundation operates from donations made from businesses, non-profits, and the public at-large. How donated funds are used is controlled by The Hope for Fertility Foundation board of directors. Donors agree to allow The Hope for Fertility Foundation to ultimately decide how fund are used and distributed.
The Hope for Fertility Foundation is a nonprofit organization under IRS Tax Code 501(c)3. Identification Number: 81-2557696. All donations made to The Hope for Fertility Foundation are tax deductible in the United States under IRC Section 170.
Accounts
In order to post comments to blog posts, you may be required to sign up for a user account on The Hope for Fertility Foundation website. No guarantees are made that content posted in comments will be made public or will remain private and The Hope for Fertility Foundation reserves the right to publish and/or remove any comments under its own discretion.
Indemnification
You hereby agree to indemnify, defend and hold The Hope for Fertility Foundation, its partners, officers, directors, agents, affiliates, and licensors (“the Indemnified Parties”) harmless from and against any third-party claim or liability arising out of (a) any content you submit, share, upload, post or display on the website; (b) any breach of or noncompliance with any representation, warranty or obligation in these Terms; (c) and any claim that your content violates any applicable law or infringes the rights of a third party. You shall cooperate fully in the defense of any claim. The Hope for Fertility Foundation reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You acknowledge that damages for improper use of the website may be irreparable; therefore, The Hope for Fertility Foundation is entitled to seek equitable relief, including an injunction and/or preliminary injunction, in addition to all other remedies.
Account management and security
You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access the website. Accordingly, you agree that you will be solely responsible to The Hope for Fertility Foundation for all activities that occur under your account. If you become aware of any unauthorized use of your password or account, you agree to notify The Hope for Fertility Foundation immediately at security@hopeforfertility.org
Only registered users may use the website. As a user, you may not allow third parties to access the website using your account. You are personally responsible for any use of the website through your account, whether by you or a third party.
To the extent permitted by applicable law, Lucidchart will not be liable for any failure to store, or for loss or corruption of, your content.
Privacy and your personal information

The Hope for Fertility Foundation will maintain commercially reasonable information security policies and safeguards, which include technical and organizational measures, designed to preserve the security, integrity, and confidentiality of your Content and to protect it against unauthorized access and information security threats.
Exclusion of Warranties
Nothing in these Terms, shall exclude or limit The Hope for Fertility Foundation’s warranty or liability for losses which may not be lawfully excluded or limited by applicable law. Only the limitations which are lawful in your jurisdiction will apply to you and The Hope for Fertility Foundation’s liability will be limited to the maximum extent permitted by law.
You acknowledge that the website may experience periods of downtime, including, but not limited to, scheduled maintenance. You expressly understand and agree that your use of the website is at your sole risk and that the Services are provided “as is” and “as available.” THE HOPE FOR FERTILITY FOUNDATION MAKES NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO THE WEBSITE, AND ANY INFORMATION OR MATERIALS RELATED THERETO OR MADE AVAILABLE THEREFROM, WHETHER EXPRESS OR IMPLIED. THE HOPE FOR FERTILITY FOUNDATION SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, RELIABILITY AND ACCURACY. THE HOPE FOR FERTILITY FOUNDATION DOES NOT WARRANT THAT THE WEBSITE WILL BE ERROR-FREE OR OPERATE WITHOUT INTERRUPTIONS OR DOWNTIME. THE HOPE FOR FERTILITY FOUNDATION MAKES NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO THE THIRD-PARTY APPLICATIONS AND CONTENT, AND EXPRESSLY DISCLAIMS ALL RESPONSIBILITY THEREFOR.
No advice or information, whether oral or written, obtained by you from The Hope for Fertility Foundation or through the website shall create any representation or warranty not expressly stated in these Terms.
Limitation of Liability
Subject to the previous section, you expressly understand and agree that The Hope for Fertility Foundation, its affiliates, licensors, resellers, officers, employees and agents (the “Foundation Parties”) shall not be liable to you for:
(a) any indirect, incidental, special, consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability, even if The Hope for Fertility Foundation has been advised of the possibility of such damages and even if a remedy fails of its essential purpose. This shall include, but not be limited to, any loss of use, data, business, revenues, or profits (whether incurred directly or indirectly), any loss of goodwill or business reputation, any loss of data suffered, or other intangible loss; or
(b) any loss or damage which may be incurred by you, including, but not limited to, loss or damage as a result of (i) any changes which The Hope for Fertility Foundation may make to the website, or for any permanent or temporary cessation in the provision of the website (or any features within the website); (ii) the deletion of, corruption of, or failure to store, any content and other communications data maintained or transmitted by or through your use of the website; (iii) your failure to provide The Hope for Fertility Foundation with accurate account information; or (iv) your failure to keep your password or account details secure and confidential.
Subject to the “Exclusions of Warranties”, the aggregate liability of the Lucidchart Parties arising out of or in connection with the Services and these Terms is limited to your direct damages and will not exceed the greater of (a) the amounts paid by you to The Hope for Fertility Foundation during the 6 months prior to the event giving rise to the liability and (b) US $200.00.
